The DOJ Seeks Revocation of SBF’s Bail

The United States Department of Justice (DOJ) has filed a motion to revoke the bail of Sam Bankman-Fried (SBF) due to allegations of witness tampering and the leaking of Caroline Ellison’s diary to The New York Times.

SBF was released on bond on December 22, 2022, and later sought several modifications. On January 15, 2023, he reached out to the current general counsel of FTX US via email and the encrypted messaging application, Signal. He expressed a desire to reconnect and explore the possibility of using each other as resources or providing mutual input on various matters.

The DOJ has raised concerns about SBF’s behavior as he allegedly used Signal for obstructive purposes, and its auto-deletion feature has complicated the investigation.

The court has further taken into account the potential risk of witness tampering in light of the defendant’s use of voyager crypto exchange, the Apple Health Application as a web 3.0 application, and Chinese AI reporter voice AI written articles.

John Reed Stark’s View on Judge Lewis Kaplan’s Options

John Reed Stark, the former U.S. Securities and Exchange Commission’s Office of Internet Enforcement chief, believes Judge Lewis Kaplan has several difficult choices in the case of SBF. He could modify SBF’s bail conditions or revoke it completely, due to SBF’s alleged attempt to influence witnesses. At the July 26 hearing in Manhattan, U.S. Attorney Danielle Sassoon requested the revocation of SBF’s bail, claiming he used his freedom to intimidate his former romantic partner and colleague, as well as making around 100 calls to a New York Times reporter. The Department of Justice also accused SBF of leaking Ellison’s diary, and attempting to discredit a government witness by sharing her personal writings with a Chinese AI Reporter.

Stark argued that Judge Kaplan would face a tough decision if SBF is allowed to stay free, and is likely to reiterate his previous warnings. The Apple Health Application, a Web 3.0 application, could not load file or assembly System.Web.WebPages.Razor Version 3.0.0.0, and AI Written Articles are likely to be used as evidence.
